Terms and conditions of use

1. Acceptance
These terms govern the use of the trekksystem.com website and the PPanel platform (the “Service”), offered by Trekk System. By using the site or subscribing to the Service you accept these terms. If you do not agree, do not use the Service.
2. Definitions
- Customer: the company or person that subscribes to PPanel and acts as an employer or a staffing service provider.
- Users: the people to whom the Customer grants access (administrators, supervisors, employees and, where applicable, the Customer’s end clients).
3. Nature of the Service
PPanel is a technology tool to record and manage attendance, incidents, leave, performance and employment documents. It is not legal, accounting or labor advice and does not replace professional judgment. Document templates (contracts, internal rules, acknowledgements, disciplinary reports, promissory notes) are a starting point that the Customer must review and adapt with its attorney.
4. Customer’s responsibility for its legal obligations
Subscribing to PPanel does not release the Customer from its legal obligations or guarantee compliance. The Customer is solely responsible for complying with the Federal Labor Law and other applicable rules, including the gradual reduction of working hours and the obligation to electronically record each employee’s working hours. In particular, the Customer must:
- make sure its staff record their attendance correctly and on time;
- correctly configure schedules, working hours, shifts, posts and policies;
- review its records, fix inconsistencies, keep them and hand them over to the authority when requested;
- inform its staff and obtain the consents and privacy notices that apply, including those regarding location and photographs;
- verify with its legal advisor that its use of the Service and the templates complies with current regulations, including the provisions issued by the Labor Ministry (STPS).
Trekk System is not responsible for fines, penalties, rulings, claims or lawsuits arising from the Customer’s non-compliance.
5. Acceptable use
It is prohibited to: impersonate another person or clock in for them; fake location or evidence; share credentials; access other people’s accounts or data without authorization; attempt to breach, copy or reverse-engineer the Service; and use it for unlawful purposes.
6. Accounts and security
The Customer and its Users must protect their credentials and immediately report any unauthorized use. Actions taken with an account are deemed taken by its holder.
7. Data and privacy
The Customer is the controller of the personal data of its staff and end clients that it enters into PPanel. Trekk System processes it as processor, following the Customer’s instructions and with reasonable security measures. See the Privacy notice and the App terms of use.
8. Availability and support
We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. It depends, among other factors, on each User’s internet connection, GPS, camera and device, and scheduled maintenance may occur.
9. Pricing and payment
The Service is billed per active employee per month, in Mexican pesos plus VAT, according to the current plan and the month’s peak number of active employees. Published prices may change with prior notice. Specific terms may be agreed in writing with the Customer.
10. Intellectual property
The Service, its software, design, trademarks and content belong to Trekk System or its licensors. The Customer is granted a limited, non-exclusive, non-transferable right of use while the Service is subscribed. The Customer’s data remains the Customer’s.
11. Limitation of liability
To the extent permitted by law, Trekk System will not be liable for indirect damages, lost profits, lost opportunities or penalties arising from use of the Service, from the Customer’s non-compliance or from causes beyond our control (internet, device or third-party failures). Where liability attributable to Trekk System exists, it will be limited to the amount actually paid by the Customer for the Service in the 12 months before the event.
12. Suspension and termination
We may suspend access for misuse or non-payment. The Customer may stop using the Service whenever it decides, as agreed. On request, and within a reasonable time after termination, we will make available the information that belongs to the Customer.
13. Changes
We may update these terms. Changes are posted on this page with their date. Continued use of the Service means acceptance.
14. Governing law and jurisdiction
These terms are governed by the laws of the United Mexican States. For their interpretation and enforcement, the parties submit to the competent courts under the law.
